(NO WAITING, VARIOUS STREETS, GREENLAW)

(TRAFFIC REGULATION) ORDER 2024

The Scottish Borders Council on 19 March 2024 in exercise of the powers conferred on them by Sections 1 and 2 of the Road Traffic Regulation Act 1984 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 and by of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to said Act and having complied with the statutory requirements of The Local Authorities’ Traffic Orders (Procedure) (Scotland) Regulations 1999, as amended made the above Order. The Order will come into operation on 25 March 2024.

The Order is to (a) make permanent The Scottish Borders Council (No Waiting, West High Street, Greenlaw) (Experimental Traffic Regulation) Order 2023 to (i) prohibit no waiting (loading and unloading permitted) at any time in a length of West High Street (A697) and (ii) waiting limited to 30 minutes (no return for 1 hour) on Mondays to Fridays 8:30 a.m. to 5 p.m., and on Saturdays 8.30 a.m. to 12 Noon in a length of West High Street (A697), in Greenlaw in the interests of public and road safety and traffic management, and (b) to combine it with The Berwick County Council (Greenlaw) No Waiting Traffic Regulation Order, 1968 and The Scottish Borders Council (Berwick County Council) (Greenlaw) (No Waiting Traffic Regulation Order, 1968) (Amendment No.1) Order 2009 which are hereby revoked.

A copy of the Order as made and the prior Orders to be revoked can be inspected at Traffic and Road Safety, Network, Environment and Infrastructure, The Scottish Borders Council, Newtown St Boswells, Melrose, from Mondays to Thursdays between 9:00 a.m. and 5:00 p.m. and also at the Council’s Library Contact Centre, 49 Newtown Street, Duns TD11 3AU during normal opening hours.

Any person wishing to question the validity of the Order or of any of its provisions on the grounds that it is not within the powers of the relevant enabling Act or that a requirement of any such enabling Act or of any relevant regulations made thereunder has not been complied with may, within 6 weeks from 21 March 2024, make application for the purpose to the Court of Session.
