(REGULATION OF TRAFFIC) ORDER 1978)

(AMENDMENT) ORDER 2024

The Scottish Borders Council on 13 February 2024 in exercise of the powers conferred on them by Sections 1 and 2 of the Road Traffic Regulation Act 1984 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 and by of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to said Act and having complied with the statutory requirements of The Local Authorities’ Traffic Orders (Procedure) (Scotland) Regulations 1999, as amended made the above Order. The Order will come into operation on 19 February 2024.

The Order is to make permanent The Scottish Borders Council (No Waiting, Paxton Terrace, Eyemouth) (Experimental Traffic Regulation) Order 2023 and prohibits waiting at any time (loading and unloading permitted) in lengths of road in Upper Houndlaw and Paxton Terrace, Eyemouth in the interests of public and road safety and traffic management.

A copy of the permanent Order as made, the prior Orders to be amended and a map showing said lengths of road can be inspected at Traffic and Road Safety, Network, Environment and Infrastructure, The Scottish Borders Council, Newtown St Boswells, Melrose, from Mondays to Thursdays between 9:00 a.m. and 5:00 p.m. and also at the Council’s Contact Centre, Old School Building, Coldingham Road, Eyemouth TD14 5AN during normal opening hours.

Any person wishing to question the validity of the Order or of any of its provisions on the grounds that it is not within the powers of the relevant enabling Act or that a requirement of any such enabling Act or of any relevant regulations made thereunder has not been complied with may, within 6 weeks from 15 February 2024, make application for the purpose to the Court of Session.
