(REDETERMINATION OF MEANS OF EXERCISE OF

PUBLIC RIGHT OF PASSAGE) ORDER 201X

 

NOTICE IS HEREBY GIVEN THAT    The Scottish Borders Council propose to make an Order under Sections 1(1) and 152(2) of the Roads (Scotland) Act 1984 redetermining the means of exercise of the public right of passage over the road described in the Schedule hereto. The title of the Order is The Scottish Borders Council (Tweedbank Station to Abbotsford House) (Redetermination of Means of Exercise of Public Right of Passage) Order 201X.

A copy of the proposed Order and of the accompanying plan showing the footpaths and footways over which the means of exercise of the public right of passage is to be redetermined, together with a Statement of the Reasons for making the Order have been deposited at the Road Safety and Traffic Management, Assets and Infrastructure, Scottish Borders Council, Council Headquarters, Newtown St. Boswells. These documents are available for inspection free of charge from 8.45 a.m. to 5.00 p.m. on Mon to Thurs and 8.45 a.m. to 3.45 p.m. on Fri and are also available for inspection at the Council’s Contact Centre, Paton Street, Galashiels TD1 3AS and also at Galashiels Library, Lawyers Brae, TD1 3JQ during normal business hours from 31 May 2018 to 29 June 2018 inclusive.

Any person may by 29 June 2018 object to the making of the Order by notice in writing to the Chief Legal Officer, The Scottish Borders Council, Council Headquarters, Newtown St. Boswells, Melrose, TD6 0SA.  Objections should state the name and address of the objector, the matters to which they relate and the grounds on which they are made.

FOOTPATHS OVER WHICH THE MEANS OF EXERCISE OF PUBLIC RIGHT OF PASSAGE IS TO BE REDETERMINED.

Section A1 – Craw Wood to Abbotsferry Road

From the south westerly termination of Craw Wood in a south westerly direction via the underpass, around Gun Knowe Loch then north on the footway adjacent to Tweedbank Drive to the junction with Abbotsferry Road, a length of 716 metres shown as hatching on plan 10.

 

Section A2 – Abbotsferry Road to A6091

From the junction with Abbotsferry Road, west on the north side footway, a length of 72 metres shown as hatching on plan 10.

 

Section A3 A6091 to Abbotsford House

A6091 Melrose Bypass, west on the footpath to its termination at Abbotsford House car park, a length of 276 metres shown as hatching on plan 10.

 

The roads as specified in this Schedule, at present public footpaths and footways, shall become shared footpaths or footways and cycle paths, the right of passage being exercised on foot or by pedal cycle only.
