(REDETERMINATION OF MEANS OF EXERCISE OF

PUBLIC RIGHT OF PASSAGE) ORDER 201X

 

NOTICE IS HEREBY GIVEN THAT        The Scottish Borders Council propose to make an Order under Sections 1(1) and 152(2) of the Roads (Scotland) Act 1984 redetermining the means of exercise of the public right of passage over the road described in the Schedule hereto. The title of the Order is The Scottish Borders Council (The Black Path, Clovenfords to Tweedbank) (Redetermination of Means of Exercise of Public Right of Passage) Order 201X.

A copy of the proposed Order and of the accompanying plan showing the footpaths and footways over which the means of exercise of the public right of passage is to be redetermined, together with a Statement of the Reasons for making the Order have been deposited at the Road Safety and Traffic Management, Assets and Infrastructure, Scottish Borders Council, Council Headquarters, Newtown St. Boswells. These documents are available for inspection free of charge from 8.45 a.m. to 5.00 p.m. on Mon to Thurs and 8.45 a.m. to 3.45 p.m. on Fri and are also available for inspection at the Council’s Contact Centre, Paton Street, Galashiels TD1 3AS and also at Galashiels Library, Lawyers Brae, TD1 3JQ during normal business hours from 31 May 2018 to 29 June 2018 inclusive.

Any person may by 29 June 2018 object to the making of the Order by notice in writing to the Chief Legal Officer, The Scottish Borders Council, Council Headquarters, Newtown St. Boswells, Melrose, TD6 0SA.  Objections should state the name and address of the objector, the matters to which they relate and the grounds on which they are made.

FOOTPATHS OVER WHICH THE MEANS OF EXERCISE OF PUBLIC RIGHT OF PASSAGE IS TO BE REDETERMINED.

Section 1 – The Old Vineries East, Clovenfords

From its junction with Muscat Brae, following the west side footway adjacent to The Old Vineries in a north easterly direction to No 3 The Old Vineries, a length of 37 metres shown as hatching on plan 1.

Section 2 – The Old Vineries West, Clovenfords

From No 5 The Old Vineries, following the south side footway adjacent to The Old Vineries in a north easterly direction to no 11 The Old Vineries, a length of 95 metres shown as hatching on plan 1.

Section 3 – The Old Vineries to A72, Clovenfords

From the north side of The Old Vineries following the footway in an easterly direction and joining onto the south footway of the A72, a length of 45 metres shown as hatching on plan 1.

Section 4 – A72 East Clovenfords

From No 9 Vine Street, following the north side footway in an easterly direction to its junction with No 9 -19 Vine Street, a length of 5 metres shown as hatching on plan 1.

Section 5 – A72 Central Clovenfords

From the east side of its junction with No 9 -19 Vine Street, following the north side footway adjacent to the A72 in an easterly direction to the junction with Station Yard a length of 26 metres shown as hatching on plan 1.

Section 6 – A72 West Clovenfords

From the east side of its junction with Station Yard, following the north side footway adjacent to the A72 in an easterly direction to the junction of the access to Mossgiel, a length of 197 metres shown as hatching on plan 1.

Section 7 – A72 Mossgiel

From the east side access to Mossgiel, following the north side footway adjacent to the A72 in an easterly direction to the access to Torwoodlee Mains, a length of 1417 metres shown as hatching on plans 2 and 3.

Section 8 – A72 Torwoodlee

From the east side of  the access to Torwoodlee Mains, following the north side footway adjacent to the A72 in an easterly direction to the access to Torwoodlee Lodge, a length of 456 metres shown as hatching on plan 3.

Section 9 – A72 to Wheatlands Road

From the east side of the access to Torwoodlee Lodge, following the north side footway adjacent to the A72 in an easterly direction then along the footpath to its termination at Wheatlands Road, a length of 1532 metres shown as hatching on plans 3 and 4.

Section 10 – Wheatlands Road

From Wheatlands Road, opposite the termination of Section 9, following the east side footway in a southerly direction to the access to No 7-15 Wheatlands Road, a length of 49 metres shown as hatching on plan 4.

Section 11 – A72 King Street

From the south side of the access to No 7-15 Wheatlands road, following the east side footway in a southerly then easterly direction onto A72 King Street to the junction with Plumtreehall Brae, a length of 208 metres shown as hatching on plan 4.

Section 12 – Low Buckholmside West

From the footway on the east side of Plumtreehall Brae in an easterly direction onto the north side footway of Low Buckholmside to its termination opposite Laidlaw Court, a length of 597 metres shown as hatching on plans 4 and 5.

Section 13 – Low Buckholmside South

From the south side footway at the access to Laidlaw Court, following the south side footway west for a length of 7 metres, shown as hatching on plan 5.

Section 14 – Low Buckholmside to High Buckholmside

From the east side footway at the Laidlaw Court access road, following the south side footway in an easterly direction onto the west side footway of High Buckholmside, then from A72 Bridge Place to a point 22 metres south of A7 Ladhope Vale, a length of 136 metres, shown as hatching on plan 5.

Section 15 – A72 Bridge Place/A7 Ladhope Vale

From a point 22 metres south of A7 Ladhope Vale on the east then south side footway in a northerly then easterly direction for 80m to the access to Ladhope Vale House, a length of 102 metres, shown as hatching on plan 5.

Section 16 – A7 Ladhope Vale West

From the access to Ladhope Vale House on the south side footway in an easterly direction to the west side of access to Ladhope Vale Car Park, a length of 27 metres, shown as hatching on plan 5.

Section 17 – Ladhope Vale/Stirling Place

From the access to Ladhope Vale Car Park, following the south side footway in an easterly direction then 12metres in a southerly direction onto Stirling Place, a length of 140 metres shown as hatching on plan 5.

Section 18 – Stirling Place/Ladhope Vale East

From Stirling Place, 8 metres south of A7 Ladhope Vale east side then onto A7 Ladhope Vale in an easterly direction to its termination at access to Abbotsford Hotel car park also including the footpath link from A7 Ladhope Vale to Stirling Street, a length of 226 metres shown as hatching on plan 5.

Section 19 – Stirling Street Car Park

From a point opposite the Ladhope Vale to Stirling Street footpath link in a south easterly direction to its termination at the pedestrian crossing on the south end of Stirling Street, a length of 116 metres shown as hatching on plan 5.

Section 20 – Our Lady & St Andrew RC Church

From the pedestrian crossing at the south end of Stirling Street, following the north side footway in an easterly direction to the footway on Currie Road, a length of 88 metres shown as hatching on plan 5.

Section 21 – Currie Road

From the Abbotsford Hotel car park entrance on A7 Ladhope Vale, following the south side footway in a south easterly direction onto A7 George Craig Bridge, a length of 269 metres shown as hatching on plan 5.

Section 22 – Glenfield Footpath

From A7 George Craig Bridge, easterly onto the north side footway of Huddersfield Street then Galafoot Lane footpath then the west side footway of Winston Road, a length of 2188 metres shown as hatching on plans 6 and 7.

Section 23 – Galashiels to Tweedbank

From Winston Road opposite the termination of Section 19, on the footpath in an easterly direction onto Essenside Drive then Tweedbank Drive to its termination at the Tweedbank Station access road, a length of 1177 metres shown as hatching on plans 8 and 9.

Section 24 – Tweedbank Drive West

From the junction with Craw Wood, on the south side footway in an easterly direction to the junction of Tweedbank Industrial Estate, a length of 130 metres shown as hatching on plan 9.

Section 25 – Tweedbank Drive, Industrial Estate

From the western junction with Tweedbank Industrial Estate, following the south side footway in an easterly direction to the eastern junction of Tweedbank Industrial Estate, a length of 280 metres shown as hatching on plan 9.

Section 26 – Tweedbank Drive East/A6091 Melrose Bypass

From the eastern junction of Tweedbank Industrial Estate, following the west side footway in a southerly direction to the termination of the 40mph speed limit before the A6091 Melrose Bypass, a length of 216 metres shown as hatching on plan 9.

Section 27 – Tweedside Park

The Tweedbank Station access road running south to north at the station car park, then in a south easterly direction on the footpath to its termination at Tweedside Park, a length of 440 metres shown as hatching on plan 9.

Section 28 – Lowood

From Tweedside Park opposite the termination of Section 27, south east on the north side footway then north east on footway to its termination at the access road to Lowood, a length of 146 metres shown as hatching on plan 9.

The roads as specified in this Schedule, at present public footpaths and footways, shall become shared footpaths or footways and cycle paths, the right of passage being exercised on foot or by pedal cycle only.
