THE MORAY COUNCIL (AMENDMENT TO THE GRAMPIAN REGIONAL COUNCIL (OFF STREET CAR PARKS) ORDER 1989: (PROPOSED CHANGES TO EXISTING CAR PARK CHARGES, ELGIN): (PROPOSED PAY AND DISPLAY WAITING RESTRICTIONS – RAILWAY STATION CAR PARK, COOPER PARK AND NORTH COLLEGE STREET WEST, ELGIN) ORDER 2018

The Council has made the above Order under S35 of Road Traffic Regulation Act 1984 as amended. This Order was approved at the meeting of the Council’s Economic Development and Infrastructure Services Committee on 20th March 2018. The Order is as specified in the Northern Scot on 26th January 2018 with no outstanding objections from the consultation process.

The effect of this Order which will come into operation on 11th May 2018 will be to:-

  1. Amend certain provisions of The Grampian Regional Council (Off Street Car Parks) Order, 1989, as amended, with the effect of introducing a new system of charges in various off-street car parks in Elgin;
  2. Introduce new Pay and Display Waiting Restrictions at the Railway Station car park, Cooper Park and North College Street West car parks in Elgin; and
  3. Introduce new ticket machine technology in order that different payment methods are made available.

The proposed Order is being introduced to provide a considered approach to the future of parking provision in Elgin to best meet the varied and competing needs of different users. The objectives are to increase satisfaction in parking provision from users and businesses, maximise use of all off-street car parks and increase the use of multi-storey car parks. It is proposed that Cooper Park and North College Street West car parks are incorporated into the Order so that the Council can ensure that limited waiting restrictions are adhered to. It is also proposed to make charges for the use of the railway station car park.

The full set of new charges at each car park for vehicles permitted to use the car parks are shown in the Schedule below.

Any person who wishes to question the validity of the Order on the grounds that it is not within the powers of the Act or that any of the relevant requirements arising from the Act are not being complied with in relation to the Order may, within 6 weeks of 30/03/18 apply to the Court of Session for this purpose.
