THE MIDLOTHIAN COUNCIL TREE PRESERVATION ORDER No. 1 (2018)

LAND AT THE FORMER WELLINGTON SCHOOL, PENICUIK

Town and Country Planning (Scotland) Act 1997, Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Regulations 2010

Notice is given as follows:

On 5th December 2018 the above Order was made bringing trees at Land at the Former Wellington School, Penicuik under the planning control of Midlothian Council as Planning Authority under the above Act and Regulations whereby the Council's previous written permission is necessary before the trees can be felled or pruned. Certified copies of the order and related map may be examined between the hours of 9am and 5pm Monday to Thursday and 9am and 3.30pm on Fridays at the reception of Midlothian Council, Fairfield House, 8 Lothian Road, Dalkeith EH22 3AA, with the exception of 25th to 28th December and 31st December to 2nd January when the offices will be closed for the festive break. A copy of the order will also be available at Penicuik Library during library opening hours.

The Council's reasons for making the Order are that the trees form a visually prominent and important landscape feature in the now predominantly exposed and expansive landscape. They are widely visible from the surrounding area, especially from the A701 and A6094. They also act as a windbreak, creating a more sheltered microclimate for adjacent sites, which contributes to the setting and energy efficiency of dwellings. These trees form part of the original landscape character of the area dating back to the period between 1853 and 1895. Should the trees be felled it would have a detrimental impact on the amenity of the immediate area and the countryside, including local wildlife and biodiversity.

Any representations in relation to the Order should be made to Midlothian Council in writing, state the grounds of the representations and specify the particular trees in respect of which the representations are made. Representations must be sent to the Planning Manager, Education, Community and Economy, Midlothian Council, Fairfield House, 8 Lothian Road, Dalkeith EH22 3AA by 16th January 2019.

The Order became effective on 5th December 2018.
