EAST AYRSHIRE COUNCIL

(Various Roads, Hollybush, Waterside and B730 Coalhall to Drongan) (30mph and 40mph Speed Limits, and Amendments) ORDER 2024

East Ayrshire Council in exercise of the powers conferred on it by Section 84 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984, as amended, and all other enabling powers, and after consultation with the Chief Constable of Police Scotland in accordance with Part III of Schedule 9 to the1984 Act, hereby makes the following Order:

Citation and Commencement

1)

(a) This Order may be cited as EAST AYRSHIRE COUNCIL (Various roads, Hollybush, Waterside and B730 Coalhall to Drongan) (30mph and 40mph Speed Limits, and Amendments) ORDER 2024 and shall come into operation on (date not yet finalised) .

Interpretations

2. The interpretation Act 1978 shall apply for the interpretation of this Order as it applies to an Act of Parliament
3. In this Order the following expressions have the meanings hereby assigned to them—

“motor vehicle” unless the context otherwise requires, means a mechanically propelled vehicle intended or adapted for use on roads;

“the Act” means the Road Traffic Regulation Act 1984 as amended; “Schedule” means Schedule 1, 2 and 3 annexed and signed as relative hereto.

4. Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended by any subsequent enactment.
5. A reference in this Order to a numbered Article or Schedule is a reference to the Article or Schedule bearing that number in this Order unless otherwise stated.

Provisions

6. No person shall drive a motor vehicle at a speed exceeding 40mph on the lengths of road specified in Schedule 1 of this Order.
7. No person shall drive a motor vehicle at a speed exceeding 30mph on the lengths of road specified in Schedule 2 of this Order.
8. The Orders referred to within column 1 of Schedule 3 of this order shall be amended to the extent specified in column 2 of said schedule.
