ROAD TRAFFIC REGULATION ACT 1984

(ON STREET PARKING PLACES) (EYEMOUTH)
EXPERIMENTAL TRAFFIC REGULATION ORDER 2011
Notice is hereby given that on 21 June 2011 The Scottish Borders Council made the above Order in exercise of the powers conferred on them by Sections 9 and 10 of the Road Traffic Regulation Act 1984 ("the Act") and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act. The Order will be experimental and may continue in force for up 18 months.
The effect of the Order, which comes into operation at Midnight on 26th June 2011 will be to:
• introduce on street parking places (pay and display) on lengths of Harbour Road and Marine Parade, Eyemouth between 8.30 am to 5.30 pm, Monday to Sunday.
• charges will be 50p for up to 30 minutes and £1.00 per hour thereafter
• suspend temporarily those parts of The Scottish Borders Council (The Borders Regional Council (Various Streets, Eyemouth) (Regulation of Traffic) Order 1978, as amended where they relate to Harbour Road.
A copy of the Experimental Order, together with a map showing said lengths of road and a Statement of the Council's Reasons for making the Order, may be examined at the Traffic Section of the Department of Environment and Infrastructure, The Scottish Borders Council, Newtown St Boswells, Melrose, from Mondays to Thursdays between 8.45am and 5.00 pm and on Fridays between 8.45 am and 3.45 pm and also at the Council's Contact Centre at Old High School Building, Coldingham Road, Eyemouth during normal opening hours. The map may also be inspected on the Council's web site at http://www.scotborders.gov.uk/outabout/gettingaround/roadinfo/index.html and any person wishing to obtain technical advice on the provisions of the Order should telephone the Traffic Section on 01835 825139.
The experimental provisions can continue in force for a maximum period of 18 months trial period before a permanent Order under sections 45, 46, 49, 51 and 124 and Part IV of Schedule 9 of the Act is considered. Within a period of 6 months from the coming into operation of the Experimental Traffic Order any person may object to the making of a permanent Order. Any objection should be made in writing giving the grounds on which it is made to the Head of Legal and Democratic Services, Scottish Borders Council, Council Headquarters, Newtown St Boswells, Melrose, TD6 0SA.
Any person wishing to question the validity of the Experimental Traffic Order or any of its provisions on the grounds that it is not within the powers of the relevant enabling Act or that a requirement of any such enabling Act or any relevant regulations made hereunder have not been complied with may, within 6 weeks from the date on which the Experimental Order was made, make application for this purpose to the Court of Session.
