THE TOWN AND COUNTRY PLANNING (ENVIRONMENTAL IMPACT ASSESSMENT) (SCOTLAND) REGULATIONS 2017 – NOTICE UNDER REGULATION 21

 

RE: Erection of a wind turbine and associated works (in retrospect) at Binn Eco Park Wind Farm Glenfarg

 

The above note development is subject to Environmental Impact Assessment (EIA) and an EIA Report has been submitted to Perth & Kinross Council by BF Energy relating to a planning application in respect of the above development (planning reference: 20/00430/FLL)

 

Possible decisions relating to the application are:

 

  1. Approval of the application without conditions;

  2. Approval of the application with conditions;

  3. Refusal of the application.

     

    Copies of the EIA Report may be purchased at a cost of £250 for a printed set or a CD at a cost of £10 from Green Cat Renewables Ltd Rob Collin

    Copies of the Non-Technical Summary of the EIA Report can also be obtained on request from the above address for £10.

     

    1. hard copy of the EIA Report will not be available to view in accordance with Schedule 6, Part 3, Section 9 of the Coronavirus (Scotland) Act 2020. An electronic copy of the EIA Report, the associated planning application and other documents submitted with the current application may be viewed online at www.pkc.gov.uk/publicaccess.

     

    Any person wishing to make representations to Perth and Kinross Council about the Supplementary Information to the EIA Report should do so in writing within the 30 day period specified above online at www.pkc.gov.uk/publicaccess or to the Development Quality Manager at Pullar House, 35 Kinnoull Street, Perth, PH1 5GD. Please use or refer to the above noted planning reference number. Notification of any decision on the planning application will also be made in this newspaper and the Council’s website (detailed above).

This application may be examined at Pullar House, 35 Kinnoull Street, Perth PH1 1DS Monday to Friday 9am to 5pm (from 11am on 1st Thursday of each month and excluding Council holidays), or online at PublicAccess by entering the relevant reference number.

TOWN AND COUNTRY PLANNING (DEVELOPMENT MANAGEMENT PROCEDURE) (SCOTLAND) REGULATIONS 2008 (as amended).

(A) Regulation 20 (1) (a): Not possible to carry out neighbour notification, no premises on neighbouring land.
(B) Regulation 20 (1) (b): Applicant unable to notify all owners or agricultural tenants.
(C) Regulation 20 (1) (c): Bad Neighbour Development, proposal for one of more classes of development specified in Schedule 3.
(D) Regulation 20 (1) (d): Application does not accord with the Development Plan.

All representations should be made within 21 days for items (A) (B) (C) (D) & (E) above; otherwise 28 days for (F) & (G).

A notice under (H) indicates that a planning application for a development which was subject to an Environmental Impact Assessment has been determined; no further representations will be accepted. The decision notice can be viewed online by following the link under the application.
