THE MORAY COUNCIL (SECTION OF U123E MOSS OF BARMUCKITY ROAD – STOPPING UP) ORDER 2018
NOTICE is hereby given that The Moray Council, in order to form a road layout and access for a Business Park at BP1 Barmuckity, Elgin, Moray compliant with planning permission granted to the developer by The Moray Council on 14 July 2011, has made an Order under Section 207 of the Town and Country Planning (Scotland) Act 1997. This Order has been confirmed by The Moray Council as an unopposed Order in accordance with a decision of the Planning and Regulatory Services Committee on 21 May 2019, in terms of the 1997 Act, having been advertised in the prescribed form with no outstanding objections from the consultation process.
The effect of the said Order, as confirmed, will be to authorise the stopping-up of the following section of the U123E Moss of Barmuckity Road;
The Order was specified in the Northern Scot and Edinburgh Gazette on 03/08/18.

Any person aggrieved by the Order, as confirmed, may apply to the Court of Session before 19/07/19 to have the Order, as confirmed, quashed on the basis that the Order is not within the powers of the Act or that their interest has been substantially prejudiced by a failure to comply with the requirements of the Act or that their interest has been substantially prejudiced by a failure to comply with the Act or of the Tribunal and Inquiries Act 1992, or any Orders, Rules or Regulations under these Acts.
