ROADS (SCOTLAND) ACT 1984

THE MORAY COUNCIL

(DUFFTOWN – VARIOUS FOOTWAYS) (REDETERMINATION OF MEANS OF EXERCISE OF PUBLIC RIGHT OF PASSAGE) ORDER 2016

NOTICE IS HEREBY GIVEN THAT the Moray Council has made the above Order under Section 1(1) and 152(2) of the Roads (Scotland) Act 1984 (as amended). The effect of the Order which will come into operation on 03/03/17 will be to redetermine the means of exercise of the public right of passage on various footways in Dufftown. The sections of footway described in the Schedule and shown on the plans annexed to the Order shall become a shared use cycleway/footway, the right of passage being exercisable on a pedal cycle and foot only.

The Order was previously specified in the Northern Scot on 13/5/16. Following consideration of objections at a meeting of the Council’s Economic Development and Infastructure Services Committee on 20 September 2016, the Order has been implemented in accordance with the original proposals to provide cyclists with a legal right of passage to the existing network of footways in the Dufftown area.

Any person who wishes to question the validity of the Order on the grounds that it is not within the powers of the Act or that any of the relevant requirements arising from the Act are not being complied with in relation to the Order may, within 6 weeks of 20/01/17 apply to the Court of Session for this purpose
