TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997

 THE CITY OF EDINBURGH COUNCIL (KINLEITH MILL AREA, CURRIE, EDINBURGH) (STOPPING UP) ORDER 2015 – PO/15/8

 NOTICE IS HEREBY GIVEN THAT on 20/1/17 The Scottish Ministers in exercise of the powers conferred on them by paragraph 8(4) of Schedule 16 to the Town and Country Planning (Scotland) Act 1997 and of all other powers enabling them in that behalf confirmed, with the modifications listed below, the above mentioned Order.

The modifications to the Order are-

a).  the deletion of all the words in paragraph 3 on page 1 of the Order and the substitution for those words of the following words: “The stopping up of the lengths of road and footpath in the City of Edinburgh local government area specified in the Schedule to this Order is hereby ordered, subject to the provision of the new roads and footpaths specified in the Schedule to this Order.”;

b).the addition of the word “with” immediately after the word “junction” in line 3 of the paragraph in the Schedule to the Order that starts with the words “All that part of the Footpath”;

c).  the deletion of the words “a distance of 248 metres or thereby” from line 7 of the paragraph in the Schedule to the Order that starts with the words “All that part of the Footpath”;

d).the substitute of the words “All of the lengths of roads” for the words “All as the lengths of roads” in each of the 3 paragraphs in the Schedule to the Order that start with the words “All as the lengths of roads”;

e).  the addition of the word “with” immediately after the word “junction” in line 2 of the paragraph in the Schedule to the Order that starts with the words “All that part of the Un-named Road”; and

f).  the deletion of the words “a distance of 135 metres or thereby” from line 5 of the paragraph in the Schedule to the Order that starts with the words “All that part of the Un-named Road”.

Notice of the making of the Order appeared in Notice 2350830 in the Edinburgh Gazette Number 27574 dated 16/6/15 and in the Scotsman of that date. The effect of the Order is to stop up the lengths of footpath and road descrided in the Schedule hereto. Alternative roads and footpaths are to be provided, those being the new roads and footpaths descrided in the said Schedule. The Order shall come into operation when notification is given that the said alternative roads and footpaths have been provided.

A copy of the Order as made and confirmed, with modifications, together with the relevant maps, may be examined from 9.30 am to 3.30 pm Mon-Fri from 3/2/17 to 17/3/17 at City Chambers, High St, Edinburgh and online from 3/2/17 at www.edinburgh.gov.uk/trafficorders &   www.tellmescotland.gov.uk (public notice and map only).

Footpath linking the Water of Leith Walkway to the Un-named Road linking Blinkbonny Road to the former Kinleith Mill and to the Footbridge over the Water of Leith linking the former Kinleith Mill to Lanark Road West

All that part of Footpath linking the Water of Leith Walkway to the Un-named Road linking Blinkbonny Road to the former Kinleith Mill and to the Footbridge over the Water of Leith linking the former Kinleith Mill to Lanark Road West, from its junction with the Water of Leith Walkway northwards, then north-eastwards and then eastwards, to a point 11 metres or thereby east of the extended eastern edge of the footbridge over the Water of Leith, linking the former Kinleith Mill to Lanark Road West.

 

LENGTHS OF ROAD TO BE STOPPED UP

Un-named Road linking Blinkbonny Road to the former Kinleith Mill

All that part of the Un-named Road linking Blinkbonny Road to the former Kinleith Mill, from its junction with Blinkbonny Road south-westwards and then westwards, to a point 11 metres or thereby east of the extended eastern edge of the footbridge over the Water of Leith, linking the former Kinleith Mill to Lanark Road West.

 

NEW ROADS AND FOOTPATHS

A new road and road bridge, over the Water of Leith, will be constructed to the north-west of the existing road and join Blinkbonny Road to the development within the former Kinleith Mill. On the southern side of the Water of Leith, within the development, a network of roads and footpaths will be constructed to provide an alterative route to the present road and footpath. The network of roads and footpaths within the development will link to 3 new accesses to the Water of Leith Walkway and to the footbridge over the Water of Leith linking the former Kinleith Mill to Lanark Road West.
