THE ANGUS COUNCIL (FORMER POLICIES OF SEAVIEW, HILL STREET, MONIFIETH) TREE PRESERVATION ORDER 2013 NO 1

 

NOTICE IS HEREBY GIVEN that Angus Council (hereinafter referred to as "the Planning Authority"), in exercise of the powers conferred upon them by Section 160 of The Town and Country Planning (Scotland) Act 1997, and of all other powers enabling them in that behalf and subject to the provisions of the Forestry Act 1967 have made a Tree Preservation Order in respect of 36 individual trees and 2 groups of trees consisting of holly, common lime, cooper beech, wellingtonia, sycamore, Norway maple, horse chestnut, common yew, common walnut and sessile oak situated at Seaview Nursery, Victoria Street, Monifieth, Angus, in order to provide for their preservation in the interests of amenity and that the same shall not be felled, lopped, or otherwise interfered with without the prior consent of the Planning Authority. The Order shall take effect on 30 August 2013 being the date specified therein and shall continue in force only until the expiration of a period of six months from the date the Order was made unless the Order is confirmed by the Planning Authority within that period.

 

A copy of the Order, map and plan annexed thereto showing the trees affected by the Order may be inspected free of charge at Reception, Angus House, Orchardbank Business Park, Forfar or at the Monifieth ACCESS Office, 81 High Street, Monifieth during normal office hours. Any person wishing to make representations to the Order should do so in accordance with the provisions of Regulation 5 of the said 2010 Regulations all as detailed in the Schedule hereto, within 28 days of the date of publication of this Notice to the Head of Legal & Democratic Services, Angus Council, Angus House, Orchardbank Business Park, Forfar, DD8 1AN.

 

 S C H E D U L E

 

 (1)       Every representation to the Planning Authority with respect to an Order shall be made in writing, shall state the grounds thereof and specify the particular trees or group of trees in respect of which it is made.

 

(2)   A representation shall be duly made if it complies with paragraph (1) above and is received by the Planning Authority within 28 days from the date of service of the Notice of the making of the Order or the date of the publication of the Notice by advertisement as the case may be.
