(Scotland) Regulations 2011 – Notice under Regulation 26

 12/00963/FLL - Erection of a windfarm and associated infrastructure at Bamff Wind Farm Alyth

 

The Council as Planning Authority gives notice of the final decision in respect of the above planning application under the above regulations. The application has been approved. Details of the decision and associated documents are available to view at www.pkc.gov.uk or can be inspected free of charge during normal opening hours at Pullar House, 35 Kinnoull Street, Perth, PH1 5GD.

 

Should anyone wish to challenge the validity of the decision an application can be made to the Court of Session under the terms of Section 239 of the Town and Country Planning (Scotland) Act 1997 (as amended). TOWN AND COUNTRY PLANNING (DEVELOPMENT MANAGEMENT PROCEDURE) (SCOTLAND) REGULATIONS 2008 (as amended). (A) Regulation 20 (1) (a): Not possible to carry out neighbour notification, no premises on neighbouring land. (B) Regulation 20 (1) (b): Applicant unable to notify all owners or agricultural tenants. (C) Regulation 20 (1) (c): Bad Neighbour Development, proposal for one of more classes of development specified in Schedule 3. (D) Regulation 20 (1) (d): Application does not accord with the Development Plan. PLANNING (LISTED BUILDINGS & BUILDINGS & CONSERVATION AREAS) (SCOTLAND) REGULATIONS 1987 (E) Any development within/affecting Listed Buildings or Conservation Areas THE TOWN & COUNTRY PLANNING (ENVIRONMENTAL IMPACT ASSESSMENT) (SCOTLAND) REGULATIONS 2011 (F) Regulation 18: Publication of Environmental Statement (G) Regulation 24: Publication of Additional Material (H) Regulation 26: Publication of Decision All representations should be made within 21 days for items (A) (B) (C) (D) & (E) above; otherwise 28 days for (F) & (G). A notice under (H) indicates that a planning application for a development which was subject to an Environmental Impact Assessment has been determined; no further representations will be accepted.
